Terms of Use

These Terms of Use (“Terms”) apply to Nursing Exams (the “App”), published by Mert Korkmaz under the name MertApp (“we”, “us”). By downloading or using the App you agree to these Terms. If you do not agree, please do not use the App.

1. The App

Nursing Exams is a free study tool with practice questions, rationales, mock exams and flashcards for nursing licensing exams, including NCLEX-RN, NCLEX-PN, the UK NMC computer-based test (Part B), the Philippine Nurse Licensure Examination and general nursing practice. It is provided for personal, non-commercial exam preparation. It is not a substitute for an accredited nursing programme, official review materials or clinical training, and we do not guarantee that you will pass any exam.

2. Not affiliated with any exam provider

The App is independent exam-preparation material. It is not affiliated with, endorsed by or sponsored by the National Council of State Boards of Nursing (NCSBN), the Nursing and Midwifery Council (NMC), the Professional Regulation Commission (PRC) or any other nursing regulator. NCLEX® is a registered trademark of the National Council of State Boards of Nursing, Inc. Exam names are used only to describe what the questions help you practise. The questions are original and are not taken from any real exam.

3. Not medical advice

All clinical scenarios are fictional and for education only. Nothing in the App is medical advice, and it must not be used to diagnose or treat anyone or to make decisions about real patients. Always follow your local clinical guidelines, your institution’s policies and the advice of qualified professionals. In an emergency, contact your local emergency services.

4. How the questions are made

Questions, rationales and flashcards are drafted with the help of artificial intelligence and then checked automatically against our editorial rules. They are labelled in the App as “AI-drafted, auto-checked, not clinician-signed”: they have not yet been reviewed and signed off by a licensed clinician. They may contain errors, omissions or outdated information. Topic weights follow publicly available exam blueprints where we could verify them, and our own estimates where we could not. Translations of questions into languages other than English may be less precise than the English text. If you find a mistake, please tell us.

5. Licence

We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to download and use the App on devices you own or control, in line with these Terms and the rules of the store you got it from (the Apple Media Services Terms and Apple’s Licensed Application End User License Agreement, or the Google Play Terms of Service).

6. Acceptable use

You agree not to:

copy, extract, republish, sell or rent the App, its questions or rationales, or any part of them,
reverse engineer, decompile or try to extract the source code or question banks, except where the law expressly allows it,
interfere with the App’s advertising, for example by generating fake ad impressions or clicks,
use the App for any unlawful purpose.

7. Advertising

The App is free because it shows ads provided by Google AdMob. Ads are provided by third parties, and we are not responsible for their content or for the products and services they promote. How ad data is handled is explained in our Privacy Policy.

8. Intellectual property

The App, its design, code, questions, rationales and other original content belong to Mert Korkmaz or its licensors and are protected by copyright and other laws. The MertApp name and logos may not be used without our permission. Open-source components are used under their own licences.

9. Your progress

Your progress is stored only on your device. We cannot restore it if you delete the App, change devices, delete your data in the App or if your device storage is cleared. You can keep your own copy with Profile → Export my data.

10. Updates and availability

We may update, change or remove questions, exams, features or content, or stop offering the App, at any time. Some updates may be needed to keep using the App. We do not promise that the App will always be available or free of errors.

11. Disclaimer

The App is provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. Nothing in these Terms limits any rights you have as a consumer that cannot be limited by law.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, for exam results, for any decision made on the basis of the App’s content, or for any loss of data or progress, arising from your use of the App. Our total liability for any claim relating to the App is limited to the amount you paid for it, which is zero. This does not exclude liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded by law.

13. Apple-specific terms

If you downloaded the App from the Apple App Store: these Terms are between you and us, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support, and is not responsible for any product claims, legal compliance claims or intellectual property claims relating to the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple’s only obligation is to refund the purchase price, if any. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a US Government embargo, and that you are not on any US Government list of prohibited or restricted parties.

14. Termination

Your licence ends automatically if you break these Terms. You can stop using the App at any time by deleting it.

15. Governing law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in your local courts.

16. Changes to these Terms

We may update these Terms from time to time. The new version will be posted on this page with a new effective date. Continuing to use the App after a change means you accept the updated Terms.
