Terms of Use (EULA) – AI Speak Spanish: Practice Me

These Terms of Use (the "Terms") are a binding agreement between you ("you" or "User") and Mert App ("we", "us", "our" or the "Developer") regarding your use of the mobile application AI Speak Spanish: Practice Me (the "App").
By downloading, installing or using the App, you agree to these Terms. If you do not agree, do not download, install or use the App.
1. License
On Apple platforms, the Apple Standard End User License Agreement applies to the app license unless a valid custom EULA is separately supplied through the App Store. These terms additionally describe our service and subscription conditions. AI features may be used only by adults aged 18 or older.
We grant you a personal, non-exclusive, non-transferable, non-sublicensable and revocable license to use the App on Apple-branded devices that you own or control, as permitted by these Terms and the Usage Rules in the Apple Media Services Terms and Conditions.
2. Free Features and Premium Subscription
The App can be used for free with limited features. AI Speak Spanish Premium is offered as an auto-renewable subscription with weekly and monthly plans. Premium unlocks additional AI conversation practice, all roleplay scenarios, voice practice and smart flashcards. Online AI use is subject to service availability and fair-use limits: currently 10 requests per minute and 300 requests per day per account. Shared network and service capacity limits may also apply. These limits do not guarantee continuous service. The current price of each plan is shown in the App before you purchase and may vary by country.
- Payment: Payment is charged to your Apple ID account when you confirm the purchase.
- Auto-renewal: Your subscription renews automatically at the end of each period (weekly or monthly) at the same price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period.
- Free trial: If a free trial is offered, any unused portion of it is forfeited when you purchase a subscription.
- Managing and cancelling: You can manage or cancel your subscription at any time in your Apple ID account settings (Settings → your name → Subscriptions). Cancellation takes effect at the end of the current billing period; you keep Premium access until then.
- Deleting the App does not cancel your subscription.
- Restoring purchases: If you reinstall the App or use a new device, tap "Restore Purchases" on the Premium screen to restore your subscription.
- Refunds: All payments are processed by Apple. Refund requests must be made to Apple at https://reportaproblem.apple.com. We cannot issue refunds directly.
3. Acceptable Use
You agree to use the App only for lawful, personal and educational purposes. You agree not to:
- Use the App to create or send content that is unlawful, abusive, harassing, hateful, sexually explicit or that violates the rights of others.
- Attempt to extract, misuse or overload the AI service, or use the App to generate content for purposes unrelated to language learning.
- Reverse engineer, decompile, disassemble or attempt to extract the source code of the App, except where permitted by law.
- Interfere with or disrupt the App, its servers or connected third-party services.
We may suspend access to the App for users who violate these Terms.
4. AI-Generated Content
The App's conversations, corrections, translations and explanations are generated by artificial intelligence (Google Gemini API).
- AI-generated content may occasionally be inaccurate, incomplete or inappropriate. Do not rely on it as professional translation, legal, medical or other expert advice.
- The App is intended for language practice and educational purposes only.
- AI tutors are fictional characters. They are not real people.
5. Your Content
You keep ownership of the messages you write or speak in the App. You grant us a limited license to process them solely to provide the App's features, as described in our Privacy Policy.

7. Intellectual Property
The App, including its design, text, graphics, characters, code and other content (excluding third-party libraries and services), is owned by the Developer and protected by intellectual property laws.
8. Disclaimer of Warranties
The App is provided "as is" and "as available", without warranties of any kind, to the maximum extent permitted by law. We do not guarantee that the App will be uninterrupted, error-free or that the AI service will always be available.
9. Limitation of Liability
To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special or consequential damages arising from your use of, or inability to use, the App.
10. Apple-Specific Terms
- These Terms are between you and the Developer only, not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the App and its content.
- Apple has no obligation to provide any maintenance or support services for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, or consumer protection claims.
- In the event of any third-party claim that the App infringes intellectual property rights, the Developer, not Apple, is responsible for its investigation, defence, settlement and discharge.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms of agreement when using the App.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
11. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with a new "Last Updated" date. Continued use of the App after changes means you accept the updated Terms.
12. Governing Law
These Terms are governed by the laws of the Republic of Turkey, without regard to its conflict of law principles, except where mandatory consumer protection laws of your country of residence apply.
